Delaware and Federal Gun Ownership Restrictions

In addition to federal restrictions, Delaware law prohibits the following persons from purchasing, owning, possessing, or controlling a deadly weapon or firearm ammunition within the State:

• Felony or Crime of Violence Conviction: Any person convicted in Delaware or elsewhere of a felony or a crime of violence involving physical injury to another, regardless of whether a weapon was possessed during the crime.
• Mental Health Commitments/Findings (with relief process):
  • Any person involuntarily committed for a mental condition, unless they can demonstrate they are no longer prohibited from possessing a firearm.
  • Any person (including a juvenile) found not guilty by reason of insanity or guilty but mentally ill for a crime of violence, unless they can demonstrate they are no longer prohibited.
  • Any person (including a juvenile) found mentally incompetent to stand trial for a crime of violence, unless a subsequent finding of competency has been made, or they can demonstrate they are no longer prohibited.
• Controlled Substance Conviction: Any person convicted for the unlawful use, possession, or sale of a narcotic, dangerous drug, or controlled substance.
• Juvenile Delinquency: Any person who, as a juvenile, was adjudicated delinquent for conduct that would constitute a felony if committed by an adult, until they reach their twenty-fifth birthday.
• Juvenile Handgun Possession: Any juvenile is prohibited from possessing a handgun (defined as a pistol, revolver, or other firearm designed to be readily capable of being fired with one hand), unless the possession is for lawful hunting, instruction, sporting, or recreational activity while under the direct or indirect supervision of an adult.
• Domestic Violence/Restraining Orders:
  • Any person subject to a Family Court protection from abuse order (other than an ex parte order) for the duration of that order.
  • Any person convicted in any court of any misdemeanor crime of domestic violence.
• Fugitive Status: Any person who, knowing they are the defendant or co-defendant in a criminal case alleging any felony, becomes a fugitive from justice by failing to appear for a scheduled court proceeding.
• Lethal Violence Protection Order: Any person who is subject to a lethal violence protection order (§ 7704 of Title 10) for the duration of that order.
• Current Controlled Substance Possession: Any person who, at the same time, possesses a controlled substance and a semi-automatic or automatic firearm or a handgun.
• Valid Seizure: Any person whose deadly weapon or ammunition (except for “antique firearms”) has been validly seized as a result of a felony conviction under Delaware or federal law.
• Subject of a Relinquishment Order: Any person who is the subject of an order of relinquishment.

FEDERAL DISQUALIFICATION CATEGORIES

• Conviction (felony or misdemeanor) where the crime has a maximum imprisonment term exceeding 1 year (even if a buyer did not receive actual imprisonment exceeding 1 year).
• Warrant (felony or out-of-state misdemeanor).
• Felony pre-trial release.
• Misdemeanor crimes of domestic violence restraining/stalking/protection order mental health adjudication or commitment.
• Unlawful use or addicted to a controlled substance (including marijuana).
• Dishonorable discharge from the armed forces.
• Renounced U.S. citizenship.
• Illegal alien.
